5) What is the maximum amount of compensation for unfair dismissal?

If a claimant successfully brings an unfair dismissal claim in an employment tribunal, he/she may be awarded compensation - a basic award and a compensatory award.

The basic award is calculated with reference to length of service, age and weekly pay (on the same basis as a statutory redundancy payment). Currently the maximum basic award is £10,500.

The compensatory award is such amount as the Tribunal considers is just and equitable (subject to a cap of £66,200) having regard to the loss suffered by the employee as a result of the dismissal.

The cap in unfair dismissal claims does not apply to compensation in awards for discriminatory dismissals.
