New Deal for Communities (“NDCs”)

Experience

We have been advising an NDC for a number of years on all of the legal issues that they face both in relation to their position as landlords, their projects within the community, and their relationships with Local Strategic Partnerships, Accountable Bodies and Government Departments.

We understand the governing policies and principles that NDCs are subject to and are able to interpret legislation and policy requirements into a format readily understandable and provide advice based on sound commercial principles to ensure that the Board receives timely, relevant and practical advice.

Specific Projects

We have also been involved in a number of large projects including transfer of commercial properties as part of a stock transfer and then a transfer to an RSL with particular emphasis on clawback issues and an income stream for the NDC; negotiations and completion of the operating agreement with the accountable body; potential group structure arrangements with a Housing Trust including negotiations with Government Office for London, the NRU and other stakeholders; and, in relation to succession planning, advising on the appropriate successor body, amending governance as appropriate taking into account the changes made by the Companies Act 2006 and the requirements of the CLG.
