CHANGES BEING INTRODUCED BY THE EMPLOYMENT ACT 2008
The Employment Act 2008 received Royal Assent on 13th November 2008, although many of the changes that are being made by the Act will not be brought into force until a later date. Currently the Government intends to introduce the dispute resolution provisions on 6th April 2009. Some of the important changes are as follows:
- 1) Repeal of the statutory disciplinary, dismissal and grievance procedures
- 2) Adjustment of awards for non-compliance with a Code of Practice
- 3) Polkey Cases
- 4) Amendment to the tribunal's powers to reach a determination without having a hearing
- 5) Amendment to ACAS powers of conciliation
- 6) Extended powers in relation to awards in claims for unlawful deductions and redundancy payments
- 7) Changes to the enforcement regime for the National Minimum Wage
- 8) Amendment to trade union membership law
